ORDER DEEMING MOTION WITHDRAWN AND VACATING THE JANUARY 31, 2002 HEARING SESSION


Before the Panel is a motion by defendant General Motors Corporation (GM) seeking centralization of the two listed actions, pursuant to 28 U.S.C. § 1407, in the District of Massachusetts tur coordinated or consolidated pretrial proceedings. GM now seeks to withdraw its Section 1407 motion.

GM's Section 1407 motion included one additional action — Elodia M. Garza, et al. v. General Motors Corp., S.D. Texas, C.A. No. 2:01-469 — that was subsequently remanded to Texas state court.

IT IS THEREFORE ORDERED that the motion of General Motors Corporation for transfer under 28 U.S.C. § 1407 is DEEMED WITHDRAWN.

IT IS FURTHER ORDERED that the Hearing Session Order and the attached Schedule filed on December 13, 2001, are VACATED insofar as they relate to this litigation.
