ORDER

Patrick J. Urda, Judge.

Pending before the Court is the Commissioner's motion to dismiss for lack of prosecution filed on June 5, 2023.

On June 6, 2023, the Court issued an Order directing petitioner's heir-at-law, Mary Joseph Post to file an objection, if any, to the Commissioner's motion to dismiss for lack of prosecution. Given the pending application for probate, the Court would like to hear from the parties as to the status of that application. Accordingly, it is

ORDERED that, on or before August 21, 2023, the parties shall file a status report, preferably a joint status report, concerning the present status of this case, including whether Mary Joseph Post or any other party has been issued letters testamentary or letters of administration for the Estate of Okley L. Post, Jr. It is further

ORDERED that, in addition to regular service, the Clerk of the Court shall serve a copy of this Order and the Commissioner's motion to dismiss for lack of prosecution on Mary Joseph Post at the address located on page 3 of the motion to dismiss for lack of prosecution and on W. David Torok at the address located on page 9 of the motion to dismiss for lack of prosecution.
