On Appeal from the County Court at Law No. 4 Collin County, Texas Trial Court Cause No. 004-01546-2023
ORDER
KEN MOLBERG, JUSTICE.
We abated this prematurely-filed appeal to allow an opportunity for the trial court to sign an order memorializing its ruling on appellant's special appearance. The abatement was on appellant's motion, filed after we questioned our jurisdiction over the appeal. The trial court signed an order denying the special appearance on December 4, 2023, and a copy of the order has been included in a supplemental clerk's record filed with the Court. Accordingly, we REINSTATE the appeal.
As we now have jurisdiction over the appeal, we ORDER appellant to file her brief on the merits no later than January 19, 2024.
Our case management system reflects August 25, 2023 as the date the order denying the special appearance was signed. August 25, 2023, however, is the date the trial court orally ruled on the special appearance. Accordingly, we DIRECT the Clerk of the Court to correct our case management system to reflect the order was signed December 4, 2023. Additionally, our case management system shall be corrected to reflect that the notice of appeal was also filed December 4, 2023, but after the order denying the special appearance was signed. See Tex. R. App. P. 27.1(a).
We DIRECT the Clerk of the Court to send a copy of this order to Collin County Clerk Stacey Kemp and the parties.
