For the reasons stated in the Report of the Magistrate Judge (DE53) and upon independent review of the file, it is

ORDERED AND ADJUDGED as follows:

1. The Report of the Magistrate Judge is hereby ADOPTED.

2. The defendants' motion to strike the plaintiff's amended pleading is denied. (DE#48-1).

3. The defendant's alternative motion to modify the pre-trial statement is granted, and all dates are extended 90 days, from the dates contained in the scheduling order . (DE#48-2)

4. The defendants' motion for an extension of time (DE#47) is granted to on or before October 1, 2005, to file a motion to dismiss/motion for summary judgment .

4 . The defendants motion to dismiss for lack of prosecution filed on July 25, 2005, is denied .
