CLINTON PORTER, Defendant Below-Appellant, v. STATE OF DELAWARE, Plaintiff Below-Appellee. No. 650, 2002 In the Supreme Court of the State of Delaware. Submitted: January 3, 2003 Decided: January 24, 2003

Before VEASEY, Chief Justice, WALSH, and HOLLAND, Justices.

Joseph T. Walsh, Justice:

ORDER

This 24th day of January 2003, after careful consideration of the opening brief and the motion to affirm, we find it manifest that the Superior Court's judgment should be affirmed on the basis of its well-reasoned decision dated October 31, 2002. The Superior Court did not err in concluding that Porter's motion for postconviction relief was both time-barred and previously adjudicated and that Porter had failed to overcome these procedural hurdles.

NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED.
