Popejoy v. State

District Court of Appeal of Florida, First District
Sep 13, 1996
678 So. 2d 455 (Fla. Dist. Ct. App. 1996)

Opinion

No. 96-906.

August 14, 1996. Rehearing Denied September 13, 1996.

An appeal from the Circuit Court for Bay County. Clinton E. Foster, Judge.

William S. Popejoy, pro se, appellant.

Robert A. Butterworth, Attorney General, and Giselle Lylen Rivera, Assistant Attorney General, Tallahassee, for appellee.

Upon review of the record, we have determined that the sentencing guidelines scoresheet was incorrectly calculated. Appellant's score produced a permitted range of any non-state prison sanction or community control or 1-3 1/2 years incarceration, instead of the 1-4 1/2 years reflected on the guidelines scoresheet. The cause is REVERSED and REMANDED to the trial court to correct appellant's sentence.

ALLEN, MICKLE and LAWRENCE, JJ., concur.
