MUNICIPAL CORPORATIONS, § 370Civil Service Commission's jurisdiction to order patrolman's discharge. Where case involving charges of misconduct against patrolman in classified service of police department of City of Chicago had been taken under advisement by Civil Service Commission, a letter which Commission subsequently sent to Commissioner of Police stating that Commission recommended that patrolman be reinstated pending a decision in his case could not be construed as an unqualified order that patrolman be reinstated and did not exhaust jurisdiction of Commission; hence Commission had jurisdiction to thereafter render a decision ordering that patrolman be discharged.

Appeal from the Circuit Court of Cook county; the Hon. HARRY M. FISHER, Judge, presiding.

Judgment order affirmed. Heard in the second division, first district, this court at the October term, 1947.
