JEFFREY R. POPE & DAVIN L. POPE, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent
ORDER
Kathleen Kerrigan Chief Judge
Due to inadvertent clerical error, in the processing of the Court's Order in the above-docketed matter served March 14, 2023, Docket Entry #17 was stricken from the record by mistake. Accordingly, the lodged document has thus been re-uploaded (as Docket Entry #19), and to now clarify the record, it is
ORDERED that the Court's Order served March 14, 2023, is amended to read as follows:
On March 10, 2023, respondent filed in the above-docked matter a Motion for Leave to File Out of Time Response to First Supplement to Motion To Restrain Assessment or Collection or To Order Refund of Amount Collected (Docket Entry #16) and lodged therewith the corresponding Response to First Supplement to Motion To Restrain Assessment or Collection or To Order Refund of Amount Collected (Docket Entry #19). The motion explained that the delay had ensued in awaiting the processing of corrective requests.
The premises considered, it is
ORDERED that respondent's just-referenced Motion for Leave to File Out of Time Response to First Supplement to Motion To Restrain Assessment or Collection or To Order Refund of Amount Collected, filed March 10, 2023, is granted. It is further
ORDERED that the Clerk of the Court shall file respondent's Response to First Supplement to Motion To Restrain Assessment or Collection or To Order Refund of Amount Collected, lodged March 10, 2023, at Docket Entry #19, as of the date of this Order is served. It is further
ORDERED that the copy of such response prematurely filed March 10, 2023, at Docket Entry #15, shall be deemed stricken from the Court's record in this case.
ORDERED that, in all other respects, the Court's Order served March 14, 2023, remains in full force and effect.
