ORDER AND DECISION

Mark V. Holmes Judge.

This case was on the December 18, 2023 Los Angeles, California trial calendar. On November 27, 2024 respondent moved to dismiss it for lack of prosecution. Petitioner then took the unusual step of appealing the case to the Ninth Circuit. A check of that court's records shows that the appeal was dismissed for lack of jurisdiction. Once we had jurisdiction again, we gave petitioner until the end of April to respond. A check of the docket shows no response, so it is

ORDERED that respondent's November 27, 2023 motion to dismiss for lack of prosecution is granted. It is also

ORDERED and DECIDED that there due from petitioner for the tax year 2019 a deficiency in income tax of $5,473; and a penalty under IRC section 6662(a) of $1,094.
