On Appeal from the 199th Judicial District Court Collin County, Texas
Trial Court Cause No. 199-03434-2016
ORDER
We REINSTATE this appeal.
By order dated March 27, 2017, we abated the appeal to allow the parties an opportunity to obtain a final judgment appellant "believe[d] will eliminate" our concern as to our jurisdiction over this appeal. Specifically, we questioned whether the trial court's memorandum ruling, from which the appeal is taken, complied with the requisites of a final judgment so as to be accorded "final judgment status" and trigger the appellate deadlines. Although we ordered the parties to file a status report by April 27, 2017, they have failed to do so.
Upon further review of the record, it appears the trial court signed orders the same day it signed the memorandum ruling. Those orders are referenced in a second memorandum ruling signed on July 26, 2016 also. That ruling grants "Plaintiff's Motion to Reconsider the Motion to Sever" and attaches "[t]he signed orders."
To the extent those orders may demonstrate our jurisdiction, we ORDER Collin County District Clerk Lynne Finley to file a supplemental clerk's record containing those orders. Ms. Finley shall provide the Court written verification if those orders cannot be located. The supplemental clerk's record or requested verification shall be filed no later than May 30, 2017.
We DIRECT the Clerk of the Court to send a copy of this order to Ms. Finley and the parties.
