On February 3, 2023, petitioner filed a document that the Court characterized as a Motion to Compel Production of Documents (Index # 28). In that document petitioner requested that respondent produce documents pursuant to Rule 72.

Requests for the production of documents are served between the parties but are not filed with the Court unless it becomes necessary to file a motion to compel. See Rule 72. Accordingly, the Court will recharacterize petitioner's Motion to Compel Production of Documents as petitioner's Request for Documents and strike that document from the record.

Upon due consideration, it is

ORDERED that petitioner's Motion to Compel Production of Documents (Index # 28), filed February 3, 2023, is recharacterized as petitioner's Request for Documents. It is further

ORDERED that petitioner's Request for Documents is stricken from the Court's record in this case.
