Pending before the Court is petitioner's Motion to Proceed Remotely filed December 19, 2022. Among other things, in that motion, petitioner states that not all parties have access to a computer with a camera capable of audio video communication. On April 12, 2023, respondent filed a response to petitioner's motion stating there in no objection the granting of petitioner's motion. Because the above-referenced motion, does not indicate whether petitioner has access to a device with audio-visual capabilities, the Court will deny the motion without prejudice. Petitioner may refile a motion to proceed remotely providing the information requested on the form, including whether petitioner has access to a device with the audio-visual capability to use Zoomgov for a remote proceeding.

The Court encourages the parties to cooperate and communicate with their opponent, and to exchange documents and information, and to develop this case for trial or other resolution, so that the parties can resolve among themselves any issues that can be resolved without the Court's involvement.

Upon due consideration and because sufficient grounds have not been established at this time, it is

ORDERED that the Motion to Proceed Remotely is denied without prejudice.
