On September 5, 2023, the Court issued an Order requesting a response from the parties as to whether the Petition giving rise to this case was timely filed. On September 21, 2023, respondent filed a response indicating that the Petition was not timely filed and requesting 30 days in which to either file a Motion to Dismiss for Lack of Jurisdiction or to file a status report on the then-current status of the case.

Upon due consideration and for cause, it is

ORDERED that, on or before October 25, 2023, respondent shall file either: (1) An appropriate jurisdictional motion; and/or (2) a report establishing the basis or bases for the Court's jurisdiction and attaching thereto a copy of any supporting documentation.
