ORDER GRANTING MOTION TO WITHDRAW AS COUNSEL


Defendants' attorney, Scott Smith, moves to withdraw as counsel from this case based on a breakdown in the relationship with his clients. Plaintiffs oppose this motion based on undue prejudice and delay, an argument that is without merit, as fairness dictates Smith should be allowed to withdraw. This motion is GRANTED without the need for a hearing, pursuant to Local Rule 7.1(e)(2). Defendants shall have until June 30, 2006 to obtain new counsel and respond to any motions currently pending in this case. This Court will proceed to decide such motions after that date.

IT IS SO ORDERED.
