Opinion

Case No. SC02-1993.

December 6, 2002.

Lower Tribunal No. 2D01-3718

Decision Without Published Opinion.

ORDER DISMISSING PETITION

Petitioners have filed an "Emergency Petition to Invoke All Writs Jurisdiction, and/or Prohibition and/or Mandamus." To the extent Petitioners seek to prohibit the Second District Court of Appeal from proceeding with oral argument on September 17, 2002, the petition is dismissed as moot. We dismiss the remainder of the petition as facially insufficient. Further, we refer the instant petition to The Florida Bar for an inquiry into whether Petitioner Pitts has engaged in the unlicensed practice of law in the instant proceedings.

SHAW, PARIENTE, LEWIS and QUINCE, JJ., concur. WELLS, J., concurs as to dismissal and dissents as to referral.
