Pires v. Brasileira

Appellate Division of the Supreme Court of New York, First Department
Feb 23, 1999
258 A.D.2d 380 (N.Y. App. Div. 1999)

Opinion

February 23, 1999

Appeal from the Supreme Court, New York County (Edward Greenfield, J.).

In this litigation, ongoing for over 20 years, the IAS Court's denial of defendant's motion to stay enforcement of the judgment pursuant to CPLR 5519 (c) was entirely proper. However, the subject judgment, entered on May 30, 1995, should be corrected to reflect an award of prejudgment interest from July 2, 1987, the date of the liability verdict (CPLR 5002, 5019 N.Y.C.P.L.R. [a]; Love v. State of New York, 78 N.Y.2d 540, 544).

Concur — Sullivan, J. P., Ellerin, Williams and Wallach, JJ.
