PRESENT: , P. J., SMITH, CENTRA, FAHEY, AND PERADOTTO, JJ.

Defendant having moved for permission to proceed as a poor person and for leave to file a late appeal from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Erie on April 29, 2011,

Now, upon reading and filing the affidavits of Gregory Fisher sworn to July 19, 2011, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied with leave to renew upon filing and serving a new motion for said relief that includes, among other things, petitioner's notice of entry of the judgment entered April 29, 2011, and an affidavit of service of the notice of appeal.
