Pioneer State Mutual Insurance Company v. Alex Benson

LC No. 2022-195699-CZ

Mark J. Cavanagh Presiding Judge, Elizabeth L. Gleicher, Sima G. Patel Judges

ORDER

The motion to dismiss pursuant to MCR 7.211(C)(2)(a) is GRANTED and the claim of appeal of right is DISMISSED for lack of jurisdiction. The Court lacks jurisdiction because, insofar as the post-judgment order appealed from leaves for later determination the amount of the sanctions to be imposed, the order is not a final order as defined in MCR 7.202(6)(a)(iv), and the claim of appeal is not timely filed in relation to the April 3, 2023, order granting summary disposition in favor of defendant-appellees, the substantive final order as defined in MCR 7.202(6)(a)(i). MCR 7.203(A)(1); MCR 7.204(A)(1).
