ORDER


This matter is before the court on an amended motion to dismiss pursuant to Rule 12(b)(6) of the Federal Rules of civil procedure brought by Defendants Brian Wick and American Distribution Systems, Inc. In its complaint, Plaintiff Pinehurst, Inc., claims that Defendants violated the Lanham Trademark Act, 15 U.S.C. § 1125(a)-1125(c), and the Anti-Cybersquatting Consumer Protection Act, 15 U.S.C. § 1125(d).

On June 22, 2001, Defendants filed a motion to dismiss pursuant to Rule 12(b)(6) of the Federal Rules of Civil procedure. By a September 28, 2001, order, this court denied Defendants' motion to dismiss without prejudice holding that the FURTHER ORDERED that Defendants' answer to the first amended complaint (Doc. #21] is STRICKEN.
