Mar 7, 1984
446 So. 2d 1133 (Fla. Dist. Ct. App. 1984)

Opinion

No. 83-1198.

March 7, 1984.

Appeal from Circuit Court, Palm Beach County; John D. Wessel, Judge.

Roy J. Watson of Adams, Coogler, Watson Merkel, P.A., West Palm Beach, for appellant.

Freeman W. Barner, Jr. of Cromwell Remsen, Riviera Beach, for appellee.

AFFIRMED.

ANSTEAD, C.J. and HERSEY, J., concur.

LETTS, J. dissents with opinion.

At least a portion of the trial judge's order appears to me to be in error. Part of the damages claimed arise from work performed at an hourly rate calculated from a beginning date on which the record reflects the work did not in fact begin. As a consequence, I would reverse and remand.
