Pincourt v. Oyler

District Court of Appeal of Florida, Fourth District
Apr 25, 1979
369 So. 2d 1037 (Fla. Dist. Ct. App. 1979)

Opinion

No. 78-82.

April 25, 1979.

Appeal from Circuit Court, Palm Beach County; James R. Stewart, Jr., Judge.

Sidney M. Dubbin, West Palm Beach, for appellant.

No appearance by appellee.

In this post-judgment dissolution matter the trial court erred in reducing to judgment a debt allegedly owed by the appellant to the appellee. The motion upon which the relief was sought was insufficient to support the judgment and apparently the appellant was not given an opportunity to present a partial defense. The judgment is reversed and this cause is remanded for further proceedings should the appellee properly seek relief.

CROSS and MOORE, JJ., concur.
