INCOMPETENTS AND DELINQUENTS, § 12when judgment on petition for appointment of conservator was against manifest weight of evidence. On appeal from order denying petition for appointment of conservator for allegedly incompetent elderly woman, where it appeared that nine lay witnesses expressed opinion that woman was not mentally capable of transacting ordinary business, while ten other witnesses expressed opinion that she was capable, that minister testified that in his opinion she was senile, and that doctors testified both for and against her capability of transacting ordinary business, held that judgment of trial court was against manifest weight of evidence.

Appeal from the Circuit Court of Sangamon county; the Hon. LAWRENCE E. STONE, Judge, presiding.

Reversed and remanded with directions. Heard in this court at the May term, 1946.
