IN THE MATTER OF G. STEVEN PIGEON, PETITIONER, v. HON. DONALD F. CERIO, JR., ACTING JUSTICE OF THE SUPREME COURT, ERIE COUNTY, RESPONDENT. ERIC T. SCHNEIDERMAN, ATTORNEY GENERAL, NEW YORK STATE, INTERVENOR-RESPONDENT.


PRESENT:

The Attorney General's Office having moved to add Eric T. Schneiderman, New York State Attorney General as a necessary party to this CPLR article 78 proceeding, to expedite the proceeding, and for the Court to accept their answer for filing,

Now, upon reading and filing the affirmation of Laura Etlinger, Esq., dated October 12,2017, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and Eric T. Schneiderman, Attorney General, is joined as a party to the proceeding, and

It is further ORDERED that the Clerk is directed to accept the Attorney General's answer for filing, on the condition that two copies are served on all parties on or before October 30, 2017, and

It is further ORDERED that the proceeding is removed from the term of this Court commencing February 20, 2018, and is added to the term of this Court commencing January 8, 2018, on the condition that all parties' briefs are served and filed in accordance with this Court's scheduling order entered September 25, 2017, and

It is further ORDERED that the Attorney General's respondent's brief shall be filed and served in accordance with this Court's rules on or before December 21, 2017.
