Opinion filed November 12, 1998 JULY TERM 1998
Appeal from the Circuit Court for the Seventeenth Judicial Circuit, Broward County; Barry E. Goldstein, Judge; L.T. No. 96-19426CF10A.
Benjamin S. Waxman of Robbins, Tunkey, Ross, Amsel, Raben Waxman, P.A., Miami, for appellant.
Robert A. Butterworth, Attorney General, Tallahassee, and Debra Rescigno, Assistant Attorney General, West Palm Beach, for appellee.
Affirmed. See T.P. v. State, 585 So.2d 1020 (Fla. 5th DCA 1991); United States v. Edwards, 53 F.3d 616 (3d Cir. 1995).
DELL and SHAHOOD, JJ., concur.
GROSS, J., dissents with opinion.
I believe that the scope of the pat down search in this case exceeded the reasonable limits of a frisk for weapons. See Jamison v. State, 455 So.2d 1112 (Fla. 4th DCA 1984); Johnson v. State, 571 So.2d 107 (Fla. 3d DCA 1990).
