Pierce v. State

Supreme Court of Delaware
Jul 11, 2011
23 A.3d 865 (Del. 2011)

Opinion

No. 780, 2010.

Submitted: May 27, 2011.

Decided: July 11, 2011.

Court Below — Superior Court of the State of Delaware, in and for New Castle County, Cr. ID 0407019516.

Before HOLLAND, BERGER, and JACOBS, Justices.

ORDER

This 11th day of July 2011, after careful consideration of the parties' briefs and the record on appeal, we find it manifest that the judgment below should be affirmed on the basis of the Superior Court's well-reasoned decision dated October 5, 2010. The Superior Court did not err in concluding that appellant's second motion for postconviction relief was untimely and repetitive and that appellant had failed to overcome these procedural hurdles.

NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED.
