ORDER


AND NOW, this 12th day of February, 2003, upon consideration of defendant's partial motion to dismiss (Doc. No. 6), plaintiff's response thereto, and defendant's reply thereto, in accordance with the Memorandum issued this day, it is hereby ORDERED that the motion is DENIED.

The portion of the motion seeking to strike the request for punitive damages is — in light of plaintiff's withdrawal of his request for punitive damages in his response to the motion to dismiss — denied as moot.
