ORDER DISMISSING REMAINING CLAIMS WITHOUT PREJUDICE
This matter came on for a case management conference on September 26, 2003. Counsel for defendants National Asset Management Enterprises, Inc.; Experian, Inc.; and Equifax, Inc. appeared. Plaintiff did not appear, nor did counsel for defendants Sallie Mae Servicing Corporation or TransUnion, Inc.Defendant National Asset Management Enterprises' unopposed motion to dismiss was. Counsel for defendants Experian and Equifax both represented that their clients reached settlements with plaintiff many months ago, but that plaintiff had failed to sign their proposed settlement documentation and had ultimately stopped communicating with them. Counsel for Equifax represented that TransUnion's counsel told him that TransUnion and Sallie Mae Servicing Corp. have also settled with plaintiff, although the documentation has not been completed.
Accordingly, by order dated September 26, 2003, plaintiff was ordered to show cause, in writing on or before October 10, 2003, (a) why he failed to attend the conference on September 26, 2003; and (b) whether he had settled his claims with any or all of the remaining defendants and, if so, when he would complete the settlement documentation. Plaintiff was informed that if he failed to respond satisfactorily to the Order to Show Cause, this Court would consider dismissing his remaining claims for failure to prosecute.
Plaintiff has failed to respond to the Order to Show Cause, either in writing or otherwise, and has not contacted the Court in any way. Accordingly, plaintiff's remaining claims are DISMISSED without prejudice for failure to prosecute. The clerk shall close the file.
IT IS SO ORDERED.
