THE COURT:

It is ordered that the opinion filed herein on October 22, 2003, be modified as follows:

1. On page 4, the last sentence of the first paragraph is modified to read as follow:

The same day, plaintiffs sent Fike and Sharringhausen notice of the ruling by mail and facsimile transmission.

2. On page 8, the first three sentences of the second full paragraph are deleted so that the second full paragraph begins with the sentence:

If Fike felt he needed more time to file a reply to plaintiffs opposition, he could have brought his own ex parte application for an additional continuance or at least raised the point at oral argument on his petition.

There is no change in the judgment.

The petition for rehearing is denied.
