FINDINGS RECOMMENDATIONS


By order filed October 19, 2010, petitioner was ordered to show cause, within twenty-one days, why his action should not be dismissed due to petitioner's failure to file an opposition to respondent's motion to dismiss filed April 26, 2010. Petitioner was cautioned that failure to respond to the court's order, or to file an opposition to the pending motion to dismiss, would result in a recommendation that this action be dismissed. The deadline has now expired, and petitioner has not shown cause or otherwise responded to the court's order or to respondent's motion to dismiss the petition.

Accordingly, IT IS HEREBY RECOMMENDED that this action be dismissed without prejudice. See Local Rule 110, 230 ( l); Fed.R.Civ.P. 41(b). Respondent's motion to dismiss (Dkt. No. 10) should be denied as moot.

These findings and recommendations are submitted to the United States District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). The parties are advised that failure to file objections within the specified time may waive the right to appeal the District Court's order. Martinez v. Ylst, 951 F.2d 1153 (9th Cir. 1991).
