ORDER


Plaintiff Ronald Phillips filed this action pro se on April 26, 2000. Since that time, the court has issued two orders, including a report and recommendation by the Magistrate Judge recommending that this action be dismissed. The Clerk mailed copies of both orders to the last (and only) address plaintiff provided the court for himself. Both orders were returned by the United States Postal Office as "undeliverable" and "unforwardable." After due consideration, it is

ORDERED that, without objection, the report and recommendation of the Magistrate Judge made under 28 U.S.C. § 636(b)(1)(A) is ADOPTED as the opinion of this court. Additionally, the court finds that this action is due to be dismissed based on plaintiff's failure to prosecute, including his failure to keep the Clerk apprized of his mailing address. Accordingly, it is ORDERED that this action is DISMISSED without prejudice.
