NOTICE OF NAME CHANGE OF PLAINTIFF PHILIP MORRIS INCORPORATED AND REQUEST TO AMEND CAPTION; ORDER THEREON

PLEASE TAKE NOTICE that effective January 15, 2003, Plaintiff PHILIP MORRIS INCORPORATED has changed its corporate name to PHILIP MORRIS USA INC. Philip Morris USA Inc. is the same entity as Philip Morris Incorporated, it merely changed its name for business purposes. In the interests of judicial economy and to avoid confusion, Philip MORRIS USA Inc. respectfully requests an Order from this Court, in the form attached hereto, amending the caption in this action to reflect this name change.

ORDER

IT IS HEREBY ORDERED that the caption in this action is amended by substituting the name "Philip Morris USA Inc." for "Philip Morris Incorporated." All further pleadings and papers Filed in this action shall conform to this amendment.
