ORDER DENYING ON RECONSIDERATION MOTION OF THE PLAINTIFF FOR EXTENSION OF TIME TO RESPOND TO DISCOVERY


A status conference was held on January 4, 2005. Present were Robert H. Love, attorney for the plaintiff, and Robert D. Meyers, attorney for the City of Memphis. From statement of counsel, it appears to the court that the motion of the plaintiff for extension of time to respond to discovery was never served on the City of Memphis, that the attorney for the plaintiff failed to consult with the attorney for the City of Memphis before filing the motion, and that the City of Memphis opposed any extension of time. Accordingly, the order dated December 1, 2004, granting the plaintiff additional time to respond to discovery is hereby rescinded, and the motion of the plaintiff for an extension of time to respond to discovery is denied.

IT IS SO ORDERED.
