On March 26, 2024, Appellant Justin C. Pfeiffer filed his notice of appeal from the trial court's final judgment, and then a Notice of Intent to File Appendix in lieu of the clerk's record pursuant to Texas Rule of Appellate Procedure 34.5a. On March 28, 2024, Appellees David H. Berg & David H. Berg & Associates PC, d/b/a Berg & Androphy ("Berg") filed a cross notice of appeal. The clerk's record for Berg's appeal was filed on May 9, 2024, and the reporter's record was filed on July 9, 2024.
The Court set the deadline of August 8, 2024 for the parties to file their opening briefs. On July 15, 2024, Cross-Appellant Berg filed a Motion to Set Staggered Briefing Schedule on Appeal and Cross-Appeal, asserting that the "staggered briefing will avoid burdening the Court with duplicative factual and procedural background briefing." Appellant Pfeiffer responded, opposing the motion. Cross-Appellant Berg's Motion to Set Staggered Briefing Schedule is denied.
On July 26, 2024, Cross-Appellant Berg filed, in the alternative, an Unopposed Motion for Extension of Time to file its opening brief, requesting a thirty-day extension until September 9, 2024. Cross-Appellant Berg stated it would not be opposed to the granting of the same extension for Appellant Pfeiffer.
Cross-Appellant Berg's Motion for Extension of Time is granted. Cross-Appellant Berg's opening brief is due on or before September 9, 2024.
Appellant Pfeiffer's opening brief and appendix are due on or before September 9, 2024.
It is so ORDERED.
