ORDER
On March 26, 2024, Appellant Justin C. Pfeiffer filed his notice of appeal from the trial court's final judgment. Subsequently, on March 28, 2024, he filed a Notice of Intent to File Appendix in lieu of the clerk's record pursuant to Texas Rule of Appellate Procedure 34.5a. See Tex. R. App. P. 34.5a (stating Appellant in a civil case may file appendix in lieu of a clerk's record). An appellant who files a notice of election under Rule 34.5a "must file the appendix at the same time as the appellant's brief." Id. The brief and appendix must be filed within 30 days after the later of (1) the date the appellant files his notice of election under Rule34.5(a) or (2) the date the reporter's record, if any, is filed with the court of appeals. Id.
On March 28, 2024, Appellees David H. Berg & David H. Berg & Associates PC, d/b/a Berg & Androphy ("Berg") filed a cross notice of appeal. The clerk's record for Berg's appeal was filed on May 9, 2024. The reporter's record was filed on July 9, 2024.
Appellant Pfeiffer's opening brief and appendix is due on August 8, 2024 (thirty days from the date the reporter's record is filed). See Tex. R. App. P. 34.5a.
Cross-Appellant Berg's opening brief is due on August 8, 2024 (thirty days from the date the reporter's record is filed). See Tex. R. App. P. 38.6(a).
