These consolidated cases were calendared for trial on the Court's October 25, 2021, Denver, Colorado remote trial session. On September 27, 2021, the parties filed a joint motion for continuance of trial. On October 1, 2021, the Court held a conference call with the parties to discuss the status of these cases, and by order served on October 1, 2021 granted the parties joint motion for continuance and retained jurisdiction over these consolidated matters.
The parties have since filed two status reports, on December 3, 2021 and February 4, 2022, respectively, updating the Court as to the then present status of these consolidated matters. The Court on February 14, 2022 held a telephone status conference with the parties, and it was agreed that these consolidated matters should be set for a Special Trial Session lasting between 3-5 days.
Accordingly, it is
ORDERED that these consolidated cases are calendared for trial at a Special Trial Session, commencing at 10:00am (MT) on Monday October 24, 2022, in Room C502 (5th Floor) at the Byron G. Rogers U.S. Courthouse, 1929 Stout Street, Denver, CO 80294. It is further
ORDERED that the Clerk of the Court is directed to issue a Standing Pretrial Order in these consolidated cases, setting out the Court's standing procedures for in-person trials.
The parties attention is also drawn to the Court's Standards and Protocols for in-person trials, and this guidance can be found on the Court's website at: ustaxcourt.gov.
This order constitutes official notice of the same to the parties.
