Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion for substitution and to amend the caption is granted, without costs, and Members Trust Company FSB, Visions FCU, as executor of the estate of petitioner Charles Pettus, is substituted for petitioner Charles Pettus upon the appeal, and it is further

ORDERED that the motion to withdraw and discontinue the appeal is granted, without costs.
