This case is calendared for trial at the Court's February 14, 2022, San Francisco, California trial session. On December 13, 2021, the Commissioner filed a Motion for Summary Judgment and petitioner's response is due on January 14, 2022. On January 12, 2022, petitioner filed a Motion for Continuance from the trial session. Commissioner does not object. The motion for summary judgment remains pending, and petitioner's response remains due. For the reasons stated in the petitioner's motion, it is

ORDERED that the petitioner's Motion for Continuance filed January 12, 2022, is granted and this case is continued and stricken from the Court's February 14, 2022, San Francisco, California trial session. It is further

ORDERED that, because there is a pending motion in this case, jurisdiction is retained by the undersigned.
