ORDER


This matter came before the court on a motion in limine by defendant Hilton Hotels. The motion was heard at a hearing on June 3, 2004, and the court ruled on most of the issues raised in that motion. Some issues, however, were taken under advisement subject to further briefing by the parties. This order memorializes the briefing schedule articulated at yesterday's hearing.

1. By June 11, 2004, defendant Hilton Hotels is to renew its motion to exclude documents in light of the court's rulings on the other issues;
2. By June 11, 2004, plaintiff Robert Pett is to brief the court on the following issues:
a. Any argument to reconsider the court's ruling to reserve ruling on back pay or front pay in light of McCue v. Kansas, 165 F.3d 784 (10th Cir. 1999);
b. What evidence he intends to offer at trial in support of his punitive damages claim;
c. Assuming the court's ruling on frontpay and backpay remains, what damages issues (other than punitives) remain for the jury to decide;
3. By June 18, 2004, both parties shall respond to any brief filed by the opposing party.

Finally, in an earlier order promised to give a written copy of preliminary instructions to the jury. The court believes that this action is unnecessary and now notifies the parties it does not intend to provide jurors with a written copy of its preliminary instructions.

SO ORDERED.
