Petrelli Associates v. Germano

Appellate Division of the Supreme Court of New York, Second Department
Nov 28, 2000
277 A.D.2d 439 (N.Y. App. Div. 2000)

Opinion

Argued November 3, 2000.

November 28, 2000.

In an action for specific performance of a contract for the sale of real property and to recover damages for breach of contract, the defendants August T. Segreto and Denise Segreto appeal, as limited by their brief, from so much of an order of the Supreme Court, Suffolk County (Klein, J.), dated March 9, 2000, as granted that branch of the plaintiff's motion which was to dismiss their second counterclaim alleging abuse of process.

Richard W. Young, Babylon, N.Y., for appellants.

Pachman Pachman, P.C., Commack, N.Y. (Matthew E. Pachman of counsel), for respondent.

Before: WILLIAM C. THOMPSON, J.P., THOMAS R. SULLIVAN, GABRIEL M. KRAUSMAN, ANITA R. FLORIO, JJ.

DECISION ORDER

ORDERED that the order is affirmed insofar as appealed from, with costs.

The Supreme Court properly determined that the appellants' second counterclaim alleging abuse of process failed to state the essential elements for such a claim (see, Curiano v. Suozzi, 63 N.Y.2d 113; EECP Ctrs. of Am. v. Vasomedical, Inc., 265 A.D.2d 372).
