ORDER

Patrick J. Urda Judge

This case was called on May 17, 2021, during the remote trial session for Buffalo, New York, and jurisdiction was retained by the undersigned.

The Court issued an Order on August 19, 2021, after a conference call with the parties during which Mr. Kotrides indicated his desire to retain an attorney. We directed that, if Mr. Kotrides were able to retain an attorney, that attorney file an entry of appearance, or, if not, Mr. Kotrides himself file a status report explaining in detail what had happened since the conference call. As of the service of this Order, we have seen neither an entry of appearance nor a status report.

In light of this silence, we return to the Commissioner's pending motion for summary judgment. We will give Mr. Kotrides a final chance to file a response to the Commissioner's motion before acting. Mr. Kotrides shall refer to docket index #9 for a Q&A regarding motions for summary judgment.

Upon due consideration, it is

ORDERED that, on or before November 8, 2021, Mr. Kotrides shall file a response to the Commissioner's motion for summary judgment. Should Mr. Kotrides fail to file a response, the Court may grant the Commissioner's motion and enter a decision accordingly.
