A purported appeal having been taken from an order of the Supreme Court, New York County, entered on or about July 5, 2016, And plaintiff-appellant having moved to enjoin a certain non-party and/or his agents, from moving or transferring any or all records subject to a subpoena dated August 16, 2012, a motion to compel dated December 7, 2015, and an order entered February 26, 2016 deciding the motion from which the aforesaid purported appeal is being taken from, and directing the non-party to disclose the location and condition of certain files, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is denied.
