Molly Brianne Peterman v. Todd Jeffrey Duckett

LC No. 20-000877-DC

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction because the October 11, 2023 order appealed from is not a final order as defined in MCR 7.202(6). MCR 7.203(A)(1). The postjudgment order requiring the parties' minor child to begin attending public school cannot be considered an order that grants or denies a motion to change legal custody, physical custody, or domicile under MCR 7.202(6)(a)(iii). Dismissal is without prejudice to the filing of an application or delayed application for leave to appeal under MCR 7.205, provided such a filing meets all requirements under the court rules and is not time-barred.

The motions for immediate consideration and for stay are DENIED as moot.
