Andrew Pete v. The State of Texas
Trial court: 179th District Court of Harris County, Texas, Trial court case numbers: 1751814, 1751815
ORDER
Julie Countiss, Judge.
On October 13, 2023, appellant filed pro se Motions for Harris County District Attorney Office to Prosecute for Aggravated Perjury in Above Cause and Case Nos. On October 20, 2023, appellant filed pro se Amended Motions for Harris County District Attorney Office to Prosecute for Aggravated Perjury in the Above Cause and Case Nos. Appellant is represented by appointed appellate counsel and is not entitled to hybrid representation. See Ex parte Taylor, 36 S.W.3d 883, 887 (Tex. Crim. App. 2001) ("Appellants are not allowed to have 'hybrid representation' on appeal, in which an appellant and [appellant's] attorney can present independent points to an appellate court.").
Accordingly, we dismiss appellant's pro se October 13, 2023 and October 20, 2023 motions. See Ex parte Bohannan, 350 S.W.3d 116, 116 n.1 (Tex. Crim. App. 2011) ("We have received numerous documents from [appellant] himself, but [appellant] is represented by counsel and is not entitled to hybrid representation. Because [appellant] is represented by counsel, we disregard his numerous pro se submissions and take no action on them."); Simmons v. State, 672 S.W.3d 821, 829 n.3 (Tex. App.-Corpus Christi 2023, no pet.) (where appellant represented by counsel on appeal, declining to address appellant's pro se motion).
It is so ORDERED.
