DECISION & ORDER ON MOTION

Motion by appellant, in effect, for leave to withdraw an appeal from a judgment of the Civil Court of the City of New York, Queens County, entered October 11, 2016, and for the release of funds on deposit.

Upon the papers filed in support of the motions and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking, in effect, leave to withdraw the appeal is granted and the appeal is marked withdrawn; and it is further,

ORDERED that the branch of the motion seeking the release of funds on deposit is granted and the New York City Department of Finance is directed to release the funds on deposit in this matter to appellant Travelspan Vacations, Inc., less any lawful fees.
