DECISION AND ORDER


1. Plaintiffs, acting pro se, commenced the above-captioned action on May 6, 2002, by filing a Complaint in the United States District Court for the Western District of New York.

2. On October 30, 2003, Defendants filed a Motion for Summary Judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure.

3. On May 25, 2004, the Honorable Leslie G. Foschio, United States Magistrate Judge, filed a Report and Recommendation, which recommended that Defendants' motion be granted.

4. Plaintiff Seunarine Persad filed Objections to Judge Foschio's Report and Recommendation on June 9, 2004.

5. This Court having carefully reviewed de novo the Report and Recommendation, as well as the pleadings and materials submitted by the parties,

IT HEREBY IS ORDERED that this Court accepts Judge Foschio's Report and Recommendation (Docket No. 40) in its entirety, including the authorities cited and the reasons given therein.

FURTHER, that Defendants' Motion for Summary Judgment (Docket No. 27) is GRANTED.

FURTHER, that Plaintiff's Objections (Docket No. 41) to the Report and Recommendation are DENIED.

FURTHER, that the Clerk of the Court shall take the steps necessary to close this case.

SO ORDERED.
