Opinion

April 11, 1950.

Present — Glennon, J.P., Cohn, Callahan, Van Voorhis and Shientag, JJ.; Callahan and Van Voorhis, JJ., dissent and vote to reverse and order a new trial on the ground that it was improper to grant a nonsuit upon the counterclaim.


Judgment, as amended, modified by deleting the words: "This judgment shall not be dischargeable in bankruptcy by any of the defendants" and, as so modified, affirmed, without costs. No opinion.
