Appeal, No. 229, March T., 1970, from order of Court of Common Pleas of Cambria County, June T., 1970, No. 128, in case of Lester J. Perkins, administrator of estate of Timothy V. Perkins, deceased, v. Johnstown City and Charles A. LaPorta. Order affirmed; reargument refused December 16, 1970.

Trespass.

Preliminary objections by defendant sustained, plaintiff's complaint dismissed, opinion per curiam. Plaintiff appealed.

Order affirmed. Cf. Graysneck v. Heard, 422 Pa. 111, 220 A.2d 893 (1966), and Stouffer v. Morrison, 400 Pa. 497, 162 A.2d 378 (1960).
