Jerrold Mark Perkins Petitioner v. Commissioner of Internal Revenue Respondent
ORDER
Elizabeth A. Copeland Judge.
This case is calendared for Trial during the Court's August 23, 2021, Washington, D. C., Trial Session to be conducted remotely at a date and time certain of 1:00 p.m. ET on Tuesday, August 24, 2021.
On August 20, 2021, the Court held a telephonic conference with the parties during which time petitioner, Jerrold Perkins, indicated that due to a family emergency and his ongoing health issues he hadn't been able to prepare for trial or meet the Court's deadlines for a pre-trial memo nor for lodging proposed trial exhibits with the Court. Mr. Perkins requested additional time in order to review a settlement proposed by respondent's counsel and, if necessary, provide additional information and documents to respondent. Respondent's counsel indicated that he would not object to continuing this case in order to preserve judicial resources.
Accordingly, on August 20, 2021, respondent's counsel filed with the Court respondent's Motion for Continuance to which petitioner has no objection.
After due consideration, and for cause, it is
ORDERED that respondent's Motion for Continuance, filed August 20, 2021, is granted in that this case is stricken for trial from the September 13, 2021, New York, New York trial calendar and this case is continued with jurisdiction retained by this Division of the Court. It is further
ORDERED that, on or before October 19, 2021, the parties shall file with the Court a joint status report regarding the then present status of this case.
