No. 05-08-00968-CV

Opinion issued May 17, 2011.

On Appeal from the 162nd Judicial District Court Dallas County, Texas, Trial Court Cause No. DC-07-02741.

Before Chief Justice WRIGHT and Justices O'NEILL and LANG-MIERS.

MEMORANDUM OPINION

On September 22, 2008, the Court abated this appeal upon appellants' filing of a notice of bankruptcy. In response to our April 7, 2011 letter inquiring about the status of the bankruptcy proceedings, we received a letter from appellee's counsel stating appellant Brendon Perkins was discharged from the bankruptcy proceedings and that appellee was paid in full for its claim during the bankruptcy proceedings. Appellee requests that the appeal be dismissed, and appellants did not respond with any contrary information. Accordingly, we dismiss the appeal.
