ORDER
This matter comes before the Court on the parties' Agreed Motion for Entry of Final Judgment (Doc. #12), filed October 25, 2002. Having reviewed the motion, the Court will enter the proposed Permanent Injunction contemporaneously with the entry of this Order. Also before the Court is plaintiff's
The Court notes that the Motion (Doc. #12) does not name James L. Pepper as a party to the motion, however, counsel for James L. Pepper signed the joint motion and the proposed permanent injunction provides for James L. Pepper. Therefore, the Court will construe the motion as including James L. Pepper.
Notice of Dismissal Without Prejudice (Doc. #13) whereby plaintiff seeks to dismiss, without prejudice, the remaining defendants, various John Does, Jane Does, and ABC Companies.
Accordingly, it is now
ORDERED AND ADJUDGED:
1. The parties' Agreed Motion for Entry of Final Judgment (Doc. #12) is GRANTED. The Court will enter a separate Permanent Injunction contemporaneously with this Order.
2. The Clerk of the Court shall enter judgment providing that the case as between Plaintiff Pepper's Fine Foods, Inc. and Defendants Pepper's Butcher Shop Deli, Inc., and James L. Pepper is resolved by the entry of the Permanent Injunction.
4. Upon entry of the judgment, the Clerk shall enter a separate judgment DISMISSING without prejudice the remaining defendants, various John Does, Jane Does, and ABC Companies.
5. The Clerk of the Court is directed to terminate any pending motions and previously scheduled deadlines and close the file.
